A judge has dismissed child abuse and other charges against a Tennessee mom seen on viral video blowing smoke in her baby daughter’s face.

In a Twitter post, WTVC-TV anchor Latricia Thomas stated that prosecutors said although the video was “disturbing,” they would be hard-pressed to prove their case in court against Tybresha Sexton.

Sexton, 24, was charged earlier this month with child abuse or neglect, resisting arrest and disorderly conduct after authorities were tipped off about the 43-second video. Watch the video through this link.

Thomas said the baby’s grandmother already had custody of the child before the video was posted.

The video showed Sexton holding the 1-month-old baby with one hand while blowing smoke in her face, and at one point she can be seen shaking the girl.

Sexton was being held on $100,000 bond before the charges were dropped.
