Jennifer Lopez hit with $150,000 lawsuit for posting a photo of herself and fiancé on Instagram

Actress, Jennifer Lopez, also known by her nickname J.Lo, has been hit with a $150,000 lawsuit by the Splash News and Picture Agency for copyright infringement over a photo of herself and fiancé Alex Rodriguez found on Instagram. She allegedly posted the photo on her Instagram page two years ago.

According to Pagesix, the lawsuit filed in US District Court for the Central District of California on Saturday, claims that J.Lo did not have permission to post the agency’s image, which showed her holding hands with her fiancé, A-Rod, in 2017 during breakfast in New York City.

The suit alleges that Splash “never licensed the photograph to [Lopez].”

“Nevertheless, Lopez used it without authorization or permission from [Splash] to do so,” the lawsuit states.

“Specifically, Lopez or someone acting on her behalf copied the photograph and distributed it on Instagram, via the @jlo account, on a story posted November 7, 2017,” the suit reads.

“The photograph is creative, distinctive and valuable,” the suit says. “Because of the subject’s celebrity status, and the photograph’s quality and visual appeal, [Splash] (and the photographer it represents) stood to gain revenue from licensing the photograph.”

The suit further states that J.Lo’s “unauthorized use harms the existing and future market for the original Photograph,” the docs continue. “The Instagram post made the Photograph immediately available to Lopez’s tens of millions followers and others, consumers of entertainment news—and especially news and images of Lopez herself, as evidenced by their status as followers of her—who would otherwise be interested in viewing licensed versions of the Photograph in the magazines and newspapers that are plaintiff’s customers.”

Splash notified Lopez of her alleged infringement through her reps in a Dec. 12, 2017 letter, according to the lawsuit.

“At the time Lopez copied and distributed the photograph, she knew or should have known she did not have authorization or permission to do so,” the suit says.

This was not the first time “Jenny from the Block” singer was sued for posting her own photo on her official Instagram account @jlo which has 102 million followers. In December 2018, Jennifer Lopez was sued by a photographer, Michael Stewart, who claimed ownership of a photo posted by J.Lo on her official Instagram account. Read more through this link
